The Nebraska Liquor Control Commission decided Wednesday it would not renew the licenses of four beer stores in Whiteclay.

The decision was hailed by activists and tribal leaders seeking to end beer sales in the unincorporated village in northwest Nebraska, near South Dakota's Pine Ridge Indian Reservation, where alcohol is banned.

Q: How does the appeal process work?

A: All appeals of Liquor Commission decisions begin in Lancaster County District Court, but further appeals could bring the case before higher courts, such as the Nebraska Supreme Court.

Q: What if that happens?

A: There's a good chance the state or the activists would appeal such a decision themselves if it came from a lower court, although Nebraska Supreme Court rulings are final.

Separately, the state Attorney General's Office has accused all four beer stores of selling to bootleggers and other violations of Nebraska law. A decision in that case could also have significant implications for the stores, including closure, and could result in its own series of appeals.

A: The two attorneys said an appeal in District Court could take anywhere from two months to half a year. A Supreme Court appeal would take significantly longer — perhaps a year or two.

Any additional lawsuits could extend that timeline even further.

A: Not really. 

While Liquor Commission decisions have been challenged — and overturned — before, neither attorney was aware of any case in Nebraska history where the commission refused to renew an existing license, let alone four, due to concern about law enforcement. Q: If the stores close, won't people just buy alcohol elsewhere?

A: Almost everyone agrees closing the stores won't end alcohol abuse by the Oglala Lakota people.

The beer stores and their supporters say it could make things worse, leading to an increase in drunk driving and violence if people from Pine Ridge head to surrounding communities to acquire alcohol.
