On July 13, 2018, the Nebraska Supreme Court upheld the district court's finding that Elizabeth Mays was an employee entitled to compensation under the federal Fair Labor Standards Act and the Wage and Hour Act. But the Supreme Court ruled that Mays qualified as a tipped employee, making her subject to an hourly wage of $2.13 per hour.
